Employer took all doctors paperwork and I never received any sick pay

Hi please could somebody help?
I had a ski accident in December and was given an Arret de Travail and signed off work for 2 weeks by the doctor. My employer insisted on taking all 4 copies of the form given by the doctor, even though the doctor said to keep one of the pages for myself. My employer said his accountant will return the form that I need to keep for myself but never did. I never received any reimbursement for the time taken off work. Is it too late to claim my reimbursement and how would I go about doing this? Did my employer do wrong?

Hello Crystal1168,

Your employer should have kept page 3 of your sick leave prescription only.

You should have send page 1 and 2 to your caisse primaire d'assurance maladie (CPAM) within 48 hours.

I advise you to contact your doctor to get a duplicate of your sick leave and send it to your CPAM with a copy of your pay slips from September, October and November along with a covering letter on which you must confirm your last day of work.

You can follow the registration of your sick leave and payment on line through your ameli account page “Mes démarches” > “Arrêts de travail”. You can also know when your file should be proceed page « Mes démarches » > « Consulter les délais de traitement de ma CPAM ».

Thank you for your response! So when my employer took all the pages of my sick leave prescription I'm not sure whether they submitted pages 1 & 2 for me. In my Ameli account under ''my steps'' >> ''work stoppages'' I can see that my work stoppage has been recorded and is displayed in this section. Unfortunately my work contract started in December so I do not have pay slips for September, October, November. Could this be the reason I have not received anything? Or shall I still contact my doctor to get a duplicate of my sick leave to send to CPAM?

To get your daily allowance paid, you must have worked 150 hours during the last 3 months or 600 hours the last 12 months before the beginning of your sick leave.

If you have not worked at all during these periods, you will not have rights opened to the daily allowance. If you have worked for another company, you should send your pay slips to your caisse primaire d'assurance maladie (CPAM).
